රුපියල් බිලියන 16ක රේගු ආදායම් වංචාවක් සම්බන්ධයෙන් කෙරෙන විමර්ශනයකට බාධා කළ බවට චෝදනා කරමින් ශ්‍රී ලංකා නීතිඥ සංගමයේ වත්මන් සභාපති රජීව් අමරසූරිය මහතාට එරෙහිව 'විනිවිද පදනම' අල්ලස් හෝ දූෂණ විමර්ශන කොමිෂන් සභාවට පැමිණිල්ලක් ඉදිරිපත් කර තිබේ. විනිවිද පදනමේ ප්‍රධාන ලේකම්, නාගානන්ද කොඩිතුවක්කු මහතා විසින් මෙම පැමිණිල්ල ඉදිරිපත් කර ඇත. BMW රථ මෙරටට ආනයනය කිරීමේදී රජයට අයවිය යුතු රුපියල් බිලියන 16ක දැවැන්ත බදු ආදායමක් අහිමි වීමේ සිද්ධියක් සම්බන්ධයෙන් කෙරෙන රේගු විමර්ශනයට අමරසූරිය මහතා බාධා පමුණුවා ඇති බව එම පැමිණිල්ලේ සඳහන් වේ. මෙම වංචාව 2011 සහ 2014 කාලසීමාව තුළ සහනදායී තීරුබදු බලපත්‍ර යටතේ මෙරටට ආනයනය කරන ලද නවතම BMW රථ 1,728ක් සම්බන්ධයෙනි. විමර්ශනවලදී හෙළි වී ඇත්තේ එම රථවල සැබෑ වටිනාකම රේගුවට ඉදිරිපත් කළ අගයට වඩා බෙහෙවින් වැඩි බවත්, ඒ සඳහා ඉදිරිපත් කළ ඉන්වොයිස් පවා ජර්මනියේ BMW සමාගම විසින් නිකුත් කරන ලද ඒවා නොවන බවත්ය. මෙම වංචාව හේතුවෙන් රජයට අහිමි වූ ආදායම රුපියල් බිලියන 16ක් පමණ වන බව ගණන් බලා ඇත. නාගානන්ද කොඩිතුවක්කු මහතා පවසන්නේ, අදාළ රේගු පරීක්ෂණයට පෙනී සිටින ලෙස අභියාචනාධිකරණය විසින් 2024 මැයි 07 වැනිදා නියෝගයක් නිකුත් කර තිබියදීත්, අදාළ සමාගම නියෝජනය කරන රජීව් අමරසූරිය මහතා ශ්‍රේෂ්ඨාධිකරණය සහ අභියාචනාධිකරණය නොමඟ යවමින් එම විමර්ශනය දිගින් දිගටම ප්‍රමාද කිරීමට කටයුතු කර ඇති බවයි. මෙම ක්‍රියාව 2023 අංක 9 දරන දූෂණ විරෝධී පනතේ 111 වගන්තිය යටතේ 'දූෂණය' යන නිර්වචනයට ඇතුළත් වන බවත්, එය ශ්‍රේෂ්ඨාධිකරණ රීති උල්ලංඝනය කිරීමක් බවත් ඔහු පෙන්වා දෙයි. මහින්ද රාජපක්ෂ පාලන සමයේ සිට වත්මන් අනුර කුමාර දිසානායක පාලනය දක්වා ජනාධිපතිවරුන් සිව්දෙනෙකු යටතේ මෙම නඩුව වසර ගණනාවක් තිස්සේ ඇදී යමින් පවතින බවත්, ජනාධිපති නීතිඥවරුන් නවදෙනෙකු සහ නීතිඥ සංගමයේ සභාපතිවරයාම මෙයට සම්බන්ධ වී සිටීම කණගාටුදායක තත්ත්වයක් බවත් පැමිණිල්ලේ සඳහන් වේ. මෙම සිද්ධිය හරහා මෙරට නීතියේ ආධිපත්‍යය බරපතළ ලෙස අභියෝගයට ලක්ව ඇති බව පවසන විනිවිද පදනම, අල්ලස් හෝ දූෂණ විමර්ශන කොමිෂන් සභාවෙන් ඉල්ලා සිටින්නේ මේ පිළිබඳව අපක්ෂපාතී සහ විශ්වසනීය විමර්ශනයක් පවත්වන ලෙසයි. එසේම, රේගු දෙපාර්තමේන්තුව මෙම අහිමි වූ බදු මුදල් අයකර ගැනීමට කඩිනමින් පියවර නොගන්නේ නම් රේගු අධ්‍යක්ෂ ජනරාල්වරයාට එරෙහිව ද නීතිමය ක්‍රියාමාර්ග ගන්නා බව නාගානන්ද කොඩිතුවක්කු මහතා වැඩිදුරටත් අවධාරණය කර සිටියි. Investigations Launched Against Sri Lanka Bar Association President Over Alleged Tax Scam The President of the Sri Lanka Bar Association, Rajiv Amarasuriya, is facing serious allegations of obstructing an investigation related to a colossal tax revenue scam involving Rs. 16 billion. A complaint has been filed against him with the Commission to Investigate Allegations of Bribery or Corruption. This complaint was submitted by Nagaananda Kodithuwakku, the Secretary of the Commission. It alleges that Amarasuriya has hindered inquiries into a significant loss of tax revenue owed to the government due to the importation of BMW vehicles. Between 2011 and 2014, a total of 1,728 luxury BMW cars were imported under a concessionary tax license. Evidence uncovered during investigations suggests that the actual value of these vehicles significantly exceeded the amounts declared to customs, and even the invoices submitted were not certified by the German company, BMW. The projected loss to the government, attributed to this scam, stands at approximately Rs. 16 billion. Kodithuwakku pointed out that despite a court order from the Appeals Court mandating Amarasuriya’s presence for the tax inquiry on May 7, 2024, he has repeatedly delayed the investigation by circumventing the Supreme Court and Appeals Court protocols. This behavior, Kodithuwakku argues, falls under the definition of "corruption" as delineated in Section 111 of the Prevention of Corruption Act No. 9 of 2023, and amounts to a violation of judicial procedures. The case, which has been ongoing for several years, spans the administrations of four different Presidents, from Mahinda Rajapaksa to the current Anura Kumara Dissanayake government. The complaint underscores the troubling involvement of various presidential legal advisors and the Bar Association's president in this ongoing scandal. According to the Commission to Investigate Allegations of Bribery or Corruption, this incident severely challenges the dominance of law in Sri Lanka, prompting a call for an unbiased and thorough investigation into the matter. Furthermore, Kodithuwakku has stressed that if the Revenue Department fails to take immediate action to recover the lost tax funds, legal action will be pursued against the Director General of Customs. *Note: In case of any discrepancy between the Sinhala and English versions, the Sinhala version shall prevail.
