හේමසිරි ප‍්‍රනාන්දුටත් මරණ දණ්ඩනය නියම කෙරේ....

2019 වසරේ එල්ල වූ පාස්කු ඉරිදා ත්‍රස්ත ප්‍රහාරය වළක්වා ගැනීමට පූර්ව බුද්ධි තොරතුරු ලැබී තිබියදීත්, සාපරාධී ලෙස රාජකාරිය පැහැර හැරීම ඇතුළු චෝදනා රැසකට වරදකරුවන් වූ හිටපු ආරක්ෂක ලේකම් හේමසිරි ප්‍රනාන්දු සහ හිටපු පොලිස්පති පූජිත් ජයසුන්දර ට කොළඹ ත්‍රිපුද්ගල මහාධිකරණ විනිසුරු මඩුල්ල අද (31) මරණ දඬුවම නියම කළ බව පුවත්පත් වාර්තා කරයි. මෙම තීන්දුව ප්‍රකාශයට පත් කෙරුණේ විනිසුරු මඩුල්ලේ බහුතර එකඟතාවය මතය. විනිසුරු ප්‍රියන්ත ලියනගේ සහ තිලකරත්න බණ්ඩාර යන මහත්වරුන් විත්තිකරුවන් වරදකරුවන් බවට තීන්දු කළ අතර, විනිසුරු විරාජ් වීරසූරිය මහතා විත්තිකරුවන් නිදොස් කොට නිදහස් කළ යුතුය යන විරුද්ධ මතය ප්‍රකාශ කර තිබුණි. ප්‍රහාරය පිළිබඳව නිශ්චිත බුද්ධි තොරතුරු ලැබී තිබියදීත්, මහජනතාවගේ ජීවිත ආරක්ෂා කිරීමට නිසි පියවර නොගැනීම තුළින් සිදු වූ සාපරාධී නොසලකා හැරීම සම්බන්ධයෙන් නීතිපතිවරයා විසින් මොවුන්ට එරෙහිව වෙන වෙනම අධිචෝදනා ගොනු කර තිබුණි. මෙම නඩුවේ ඉතිහාසය දෙස බැලීමේදී, 2022 පෙබරවාරි 18 වනදා එවකට සිටි ත්‍රිපුද්ගල මහාධිකරණ විනිසුරු මඩුල්ල විසින් විත්තිකරුවන්ගේ විත්තිවාචකය කැඳවීමකින් තොරවම ඔවුන් නිදොස් කොට නිදහස් කිරීමට පියවර ගෙන තිබුණි. කෙසේ වෙතත්, නීතිපතිවරයා එම තීන්දුවට එරෙහිව ශ්‍රේෂ්ඨාධිකරණයට අභියාචනයක් ඉදිරිපත් කළේය. එම අභියාචනය සලකා බැලූ ශ්‍රේෂ්ඨාධිකරණය, විත්තිකරුවන් නිදහස් කිරීමට මහාධිකරණය ගත් තීරණය නීතියට පටහැනි බවත්, විත්තිකරුවන්ගේ විත්තිවාචකය කැඳවිය යුතු බවත් තීන්දු කළේය. ඒ අනුව නඩුව නැවත විභාග කරන ලෙස ශ්‍රේෂ්ඨාධිකරණය නියෝග කළ අතර, එම නැවත නඩු විභාගයේ තීන්දුව ප්‍රකාශයට පත් කරමින් අද මෙම මරණ දඬුවම නියම විය. Former Officials Sentenced to Death for Negligence Over Easter Sunday Attacks In a landmark ruling today, the Colombo High Court has sentenced former Defense Secretary Hemasiri Fernando and former Inspector General of Police Pujith Jayasundara to death for their failure to prevent the Easter Sunday terrorist attacks in 2019, despite having received prior intelligence information regarding the incident. Reports confirm that both men faced multiple charges, including the dereliction of duty. The decision was reached by a majority consensus among the judges on the bench, with Justices Priyantha Wijayatunga and Thilakawardana Bandara finding the defendants guilty. However, Justice Viraj Weerakoon presented a dissenting opinion, arguing that the accused should be acquitted as they were not responsible for the attacks. Despite the availability of specific intelligence that could have safeguarded public lives, the failure to take appropriate measures led to significant consequences, prompting the Attorney General to file separate indictments against the defendants. Looking back at the case's history, on February 18, 2022, the then-Colombo High Court had released the accused without calling for their formal trial, declaring them not guilty. This decision, however, was contested by the Attorney General, leading to an appeal in the Supreme Court. Upon reviewing the appeal, the Supreme Court ruled that the High Court's prior decision to acquit the defendants was legally flawed and mandated that the trial court must summon them for a proper hearing.
