අධිකරණ විනිසුරුවරුන්ගේ විශ්‍රාම වයස දීර්ඝ කිරීම සඳහා රජය ගෙන ඒමට උත්සාහ කරන 22 වැනි ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනය වහාම නතර කරන ලෙස ඉල්ලමින් ත්‍රෛනිකායික මහානායක හිමිවරුන් විසින් ජනාධිපතිවරයා වෙත යොමු කරන ලද විශේෂ ලිපිය සමගි ජන බලවේගයේ හිටපු පාර්ලිමේන්තු මන්ත්‍රී සුජීව සේනසිංහ මහතා (12) මාධ්‍ය වෙත ප්‍රසිද්ධ කළේය. කොළඹදී පැවැති මාධ්‍ය හමුවකදී එම ලිපිය ඉදිරිපත් කරමින් සේනසිංහ මහතා කියා සිටියේ, අධිකරණයේ ස්වාධීනත්වය සහ යුක්තිය පසිඳලීමේ ක්‍රියාවලිය කෙරෙහි පවතින මහජන විශ්වාසය පළුදු වන ආකාරයෙන් කටයුතු නොකරන ලෙස මහානායක හිමිවරුන් රජයෙන් ඉල්ලා ඇති බවයි. වර්තමාන ව්‍යවස්ථාවට අනුව අභියාචනාධිකරණ විනිසුරුවරුන්ගේ විශ්‍රාම වයස අවුරුදු 63ක් ලෙසත්, ශ්‍රේෂ්ඨාධිකරණ විනිසුරුවරුන්ගේ විශ්‍රාම වයස අවුරුදු 65ක් ලෙසත් නියම කර තිබියදී, එම වයස් සීමාවන් ඉහළ නැංවීමට රජය ගන්නා උත්සාහය කිසිසේත්ම උචිත නොවන බව මහානායක හිමිවරුන් සිය ලිපිය මගින් අවධාරණය කර තිබේ. මෙවැනි සංශෝධනයක් මගින් අධිකරණ පද්ධතියේ සුරක්ෂිතතාව පිළිබඳ බරපතළ ප්‍රශ්නාර්ථයක් මතු වන බවත්, එය අනාගතයේදී අධිකරණයේ ස්වාධීනත්වය සම්පූර්ණයෙන්ම විනාශ කිරීමට හේතු විය හැකි බවත් එම ලිපියේ වැඩිදුරටත් සඳහන් වේ. මෙම ව්‍යවස්ථා සංශෝධනයට එරෙහිව මෙරට විනිසුරුවරුන්ගේ සංගමය, නීතිඥ සංගමය සහ සිවිල් සංවිධාන පමණක් නොව, LawAsia, පොදුරාජ්‍ය මණ්ඩලීය නීතිඥ සංගමය (Commonwealth Law Association) සහ ජාත්‍යන්තර විනිසුරුවරුන්ගේ සංගමය වැනි විදේශීය ආයතන ද සිය විරෝධය පළ කර ඇති බව සේනසිංහ මහතා මෙහිදී පෙන්වා දුන්නේය. විධායකයට අවශ්‍ය පරිදි විනිසුරුවරුන්ගේ සේවා කාලය වෙනස් කිරීමට ඉඩ ලබා දීමෙන් රට ඒකාධිපති පාලනයක් කරා ගමන් කිරීමේ අවදානමක් පවතින බවත්, එබැවින් අධිකරණයේ ගෞරවය ආරක්ෂා කර ගැනීම සඳහා මෙම යෝජිත සංශෝධනයෙන් වැළකී සිටින ලෙස මහානායක හිමිවරුන් ජනාධිපතිවරයාගෙන් ඉල්ලා සිටින බව ද ඔහු වැඩිදුරටත් සඳහන් කළේය. Monks Urge President to Halt Proposed Amendment on Judges' Retirement Age In a significant move, former parliamentarian Sujeewa Senasinghe disclosed that a letter has been sent to the President from the Tri-Nikayas, urging an immediate halt to the 22nd constitutional amendment aimed at extending the retirement age of judges. During a media briefing in Colombo, Senasinghe presented the letter, emphasizing that the monks have called on the government to refrain from actions that could undermine public confidence in the independence of the judiciary and the integrity of the legal system. The current constitution stipulates that judges of the Court of Appeal can retire at the age of 63, while the retirement age for Supreme Court judges is set at 65. The letter from the religious leaders stresses that any attempts to increase these age limits are unequivocally inappropriate. Furthermore, the letter warns that such amendments could raise serious concerns about the security of the judicial system and may potentially lead to the complete destruction of judicial independence in the future. Senasinghe pointed out that opposition to the proposed amendment is not limited to local judges' associations and legal groups; international bodies such as LawAsia, the Commonwealth Law Association, and the International Bar Association have also expressed their dissent. He cautioned that allowing judges’ service durations to be altered at the executive's discretion poses a risk of steering the country towards authoritarian governance.
